Despite the drama, the lawsuit between Joe Gibbs Racing and Spire Motorsports regarding Chris Gabehart has been at a stalemate in terms of who’s actually leading. However, as per a recent update, Joe Gibbs’ team finds itself with a partial win as the recent court findings went their way, questioning the credibility of its former competition director, Gabehart.

Big trouble awaits Chris Gabehart after court’s findings?

In a recent interview with NASCAR journalist Peter Stratta and other media spokespersons, Tom Melsheimer from King & Spaulding, who is representing Joe Gibbs Racing in the lawsuit, questioned the credibility of Gabehart, their former employee. Speaking on the line, here’s what he stated:

“You never know what you don’t know. Certainly, potentially, more sharing of information, gathering of information about Mr. Gabehart, what he communicated to the folks at Spire, what he said his expectations were about what he could provide. Really, when you’ve got someone whose credibility is in shambles, like Mr. Gabehart is, you never really know what you’re going to get when you start doing it.”

Following this, the attorney explained how they hold Gabehart as the man behind the stolen confidential information, and he was not telling the truth as per court’s findings. He also mentioned how Gabehart ‘might have’ traded their successful secrets, which made them the most successful teams in the NASCAR Cup Series since 2008.

“The court has already found that he didn’t tell the truth, to put it politely, about his activities while at JGR,” Melsheimer said about the court’s findings. “He created a folder called Spire containing some of our most confidential and trade secret information. There’s no reason for him to have created that unless he was intending to use it to assist a competitor.”

This was definitely a win so far in the case for JGR, and it immediately put Gabehart’s credibility at risk as it occurred.

The recent revelation by the attorney comes amid the ongoing high-stakes lawsuit that Joe Gibbs Racing filed against Chris Gabehart and Spire Motorsports regarding corporate espionage, trade secret theft, and contract breach.

In February this year, JGR filed the lawsuit against Gabehart, alleging that Gabehart, while serving as the competition director on his team, accessed sensitive databases and photographed important documents. He then saved them in a folder named Spire.

JGR also alleged that Gabehart met Jeff Dickerson, the owner of Spire Motorsports, before his official switch from JGR to Spire. This not only went against the contract, but also seemed to be in a non-competitive spirit. As a result, Joe Gibbs Racing is now pushing to block Gabehart from working at Spire for at least 18 months, citing that they have a similar role at both teams.

On the other hand, Spire and Gabehart claimed that his role on the team is entirely different from what he did at JGR. Moreover, they also alleged that JGR owes $100,000 for a broken agreement from last year, bringing in a new twist from Spire’s side. While the lawsuit is taking its course, Denny Hamlin, Gabehart’s former aide, shared his thoughts.

JGR’s Denny Hamlin let his feelings known on JGR-Spire lawsuit

Denny Hamlin, who worked with Chris Gabehart for nearly six years, opened up about the fiasco. He was working with the latter before JGR pulled up to fill the role of a competition director. Addressing the issue, a dejected Hamlin said:

“I’ve shared the thoughts I had on Monday on why it’s really important for these teams to be able to protect their information because there’s honestly no going back. Yeah, if somehow your information gets out, there’s no going back until there’s another new car, and who knows when that will be.”

The stories of corporate espionage in motorsports are not rare. A type of sport where information is key and vital, as such mishaps or alleged theft are common, and the recent fiasco between Joe Gibbs Racing and Spire Motorsports just added another chapter to it.
