Caster Semenya is known for her long-distance running prowess and hails from South Africa. The 32-year-old track and field star conquered the competition at the London and Rio Olympics in the women’s 800m racing category. However, she was denied participation rights due to a 2019 regulations change that barred her due to her testosterone levels.

It should be noted that elevated testosterone levels naturally occur in Semenya. Despite this, the regulations demanded her to reduce it to an ambiguous extent via chemicals to pass as a woman. Forcefully taking medications to alter one’s biochemistry is a strong human rights violation. Semenya recently won her case against discrimination at the European Court of Human Rights in July 2023, according to the Human Rights Watch. Despite her victory, Semenya was denied participation rights in the recent tournaments owing to the testosterone barriers.

2x Olympic gold medalist lost two legal battles

Caster Semenya moved to the Court of Arbitration for Sports in 2019 and the Swiss Supreme Court in 2020. However, she lost both cases, and the new regulations were upheld; the same ones that barred her from participation. The Court of Arbitration for Sports holds the highest legal position in the world of sports and left Semenya devastated. Despite this, Semenya didn’t accept defeat and kept pushing hard to get what she deserved.

After a long hard-fought legal battle, the European Court of Human Rights ruled that Semenya was discriminated against. However, the legal win didn’t open the doors of participation for Semenya, as the court didn’t touch the testosterone law. While many would look at this win as a technical stalemate, it carries a lot of significance. Similar athletes will use this win as a stepping stone in the future to gain eligibility in competitions. Moreover, the support of popular athletes like Sha’Carri Richardson will also carry more momentum after combining it with the win. Semenya is looking forward to the day she and other similar athletes get to participate and win matches again.
